About This Policy
This Consumer Health Data Privacy Policy is for residents of Washington and Nevada. It explains how Floyd Technologies LLC, doing business as BiteCount ("BiteCount," "we," "us," or "our"), collects, uses, and shares "consumer health data" as defined by the Washington My Health My Data Act and Nevada Senate Bill 370, and how you can exercise your rights. It applies to the BiteCount app and our website at bitecountapp.com.

- Diet preferences and allergies, used to tailor your recommendations and AI coaching.
- Goals and goal progress, used to show your progress and create goal cards.
- Streaks and weekly logging activity, used to show your progress and, if you choose, to display them to other users.

Consumer Health Data We Share and Who We Share It With
We share consumer health data only as described below. We do not sell it, and we do not share it with affiliates.

These providers process consumer health data on our behalf, only as needed to run BiteCount:
- Cloud hosting and database (Supabase): all categories listed above.
- Food search (Railway): custom foods you create.
- Push notifications (Apple Push Notification service): streak counts and food or recipe names included in notifications.
- AI coaching (OpenAI): messages you send to our AI coach and related nutrition information.
Other BiteCount Users
Only with your separate consent:
- Your starting and ending weights and weight change, when you share a goal card that includes them.
- Your streaks and weekly logging, when you make them visible to your followers or friends.
Legal Requirements
Authorities or other parties, when required by law, such as a valid court order.
Your Consent
We collect and use your consumer health data only as necessary to provide the BiteCount features you request. We ask for your separate consent before we share it with other users, such as when you share a goal card that includes your weights or make your streaks or weekly logging visible. You can withdraw that consent at any time, as described below.
Your Rights
You have the right to:
- Confirm whether we collect or share your consumer health data, and access it, including a list of all third parties and affiliates with which we have shared it and a way to contact them.
- Withdraw your consent to our collection or sharing of your consumer health data. You can stop sharing with other users at any time. If you withdraw consent to collection, we will stop collecting your consumer health data, and you will no longer be able to use BiteCount's tracking features.
- Have your consumer health data deleted, including from our backups and by our service providers.
- Review and correct your consumer health data. Most of it can be edited directly in the app.
To exercise these rights, use the controls in the app (including Menu > Data Export and Menu > Account & Data Deletion) or email privacy@bitecountapp.com. We will verify your identity and respond within 30 days.
Appeals
If we deny your request, you can appeal by emailing privacy@bitecountapp.com with "Appeal" in the subject line. We will respond to your appeal within 45 days. If your appeal is denied, Washington residents may file a complaint with the Washington Attorney General at atg.wa.gov/file-complaint, and Nevada residents may contact the Nevada Attorney General at ag.nv.gov.
Tracking by Third Parties
We do not allow third parties to collect consumer health data about you over time and across different websites or online services through BiteCount.
Changes to This Policy
When we make material changes to this policy, we will notify you in the app or by email at least 14 days before they take effect. The effective date of this policy is shown at the top.
